“Delhi High Court Criticizes Kejriwal for Government Inactivity Caused by Chief Minister’s Absence”

The Delhi High Court recently highlighted the stagnation in the city’s governance due to Chief Minister Arvind Kejriwal’s absence, emphasizing the need to uphold fundamental rights and maintain accountability. The court expressed its concerns during discussions about the Delhi government’s performance, specifically pointing to the failure to provide textbooks to children in MCD schools amid Kejriwal’s recent arrest and absence from office. The court noted the critical role of the Chief Minister and stated that his personal interests should not compromise children’s rights or hinder governmental functions.

The High Court also accused the Delhi government of deflecting blame onto other entities, labeling these actions as merely “shedding of crocodile tears.” The court mentioned that if the government genuinely agreed with the proposed solutions from a January 15, 2024 meeting, it could have autonomously initiated measures to ensure the provision of school materials. The court further recognized a statement by Minister of Urban Development, Saurabh Bhardwaj, acknowledging that any increase in the financial authority of the MCD Commissioner would need the Chief Minister’s approval, which indirectly confirmed the governance paralysis.

Following the court’s proceedings, senior AAP leader Sanjay Singh scheduled a press conference to discuss the court’s ruling. The High Court also remarked on the importance of the Chief Minister’s role, particularly in a vibrant city like Delhi, emphasizing that this position demands continuous availability to address emergencies. Despite Kejriwal’s absence, the court stressed that officials still needed to make crucial and immediate decisions, such as providing essential school supplies, which cannot be delayed even during the electoral code of conduct.

Previously, the Delhi High Court criticized the city government for not supplying essential educational materials to MCD school children. The court pointed out that Kejriwal prioritized personal interests over national interests by not resigning from his role, despite his incarceration. This criticism was part of a hearing concerning a PIL about the deteriorating conditions in MCD schools due to administrative deadlock.
