Lucknow, Uttar Pradesh: Following the recent Supreme Court judgment on the use of demolitions in cases of illegal construction, BJP MLA Sidharth Nath Singh expressed his support for the decision. In a statement, he emphasized the Supreme Court’s validation of the legal procedures for demolitions, saying, “The judgement of the SC on demolition should be welcomed.”
The Supreme Court’s verdict clarifies that while demolitions should follow specific procedures, illegal structures, particularly those encroaching on government property, are not protected by law. Singh noted that the judgment does not prohibit demolitions but instead reinforces the legal process by outlining conditions under which such actions can be carried out. He explained, “The SC said that illegal construction cannot be demolished without due process. They defined a procedure for it, which the UP government was already following.”
Singh highlighted that the government holds the authority to act against unlawful encroachments, particularly when they are built on public land. “If someone does illegal construction, then the government has the right to demolish it within the procedure,” he said. The Uttar Pradesh government has been firm in its stance, using demolition as a means to enforce rules against illegal encroachments while adhering to court-mandated processes.
Referring to the state’s long-standing policy against encroachments, Singh emphasized that government property is protected by law and that the UP administration would continue enforcing rules. “Now, if someone grabs government land and does illegal construction, then the bulldozer will run within the law,” he concluded.
This decision by the Supreme Court has implications for future government actions against unauthorized structures. The court’s emphasis on following established procedures provides a clear framework for state and local administrations, making it clear that while action against illegal constructions is permissible, it must align with the prescribed legal process.
